Charles Miller (“Miller” or “plaintiff’) brings this action against his former employer, the National Association of Securities Dealers, Inc. (“NASD” or “defendant”), alleging that he was terminated from his employment at NASD on March 19, 2004 as a result of discrimination and thereby deprived of certain retirement benefits. By decision and order dated September 19, 2006, the Court dismissed plaintiffs state law claims with prejudice pursuant to Federal Rule of Civil Procedure 12(b)(6), leaving for consideration only his federal claims of…
