DUBINA, Circuit Judge:

Appellant/petitioner, Robert Lewis Moore (“petitioner”) appeals the district court’s order dismissing his federal habeas petition as untimely. For the reasons that follow, we affirm.

I. BACKGROUND

On November 20, 1992, a jury convicted the petitioner of second degree murder and the court sentenced him to life in prison as a violent habitual felony offender. Petitioner appealed his state judgment and sentence.
