ORDER RE: MOTION TO DISMISS

Petitioner Universal Trading & Investment Co. (“UTICo”) initiated these ancillary proceedings to assert its claims to the forfeited funds of Pavel Lazarenko, claiming (1) its interest in the funds vested prior to any criminal activity, thus its interest is superior to that of the Government; and (2) it was a bona fide purchaser for value without knowledge that the funds were subject to forfeiture.
