JOURNAL ENTRY AND OPINION

{¶ 1} Plaintiff-appellant, the State of Ohio ("the State"), appeals the trial court's imposition of community control sanctions upon defendant-appellee, Darren Pickett ("appellee"). For the reasons set forth below, we reverse and remand for resentencing.

{¶ 2} On January 17, 2008, the Cuyahoga County Grand Jury indicted appellee on four counts: Count 1 alleged aggravated burglary in violation of R.C. 2911.11(A)(1); Count 2 alleged robbery in violation of R.C. 2911.02(A)(2); Count 3 alleged grand theft motor vehicle in violation of R.C. 2913.02(A)(1); and Count 4…
