MEMORANDUM AND ORDER

TOWNES, District Judge:

Plaintiff James M. Maloney brings this action pursuant to 42 U.S.C. § 1983, alleging that defendants violated his civil rights during and after an incident which began in the afternoon on August 23, 2000, and ended in the early morning of August 24, 2000 (hereinafter, the “Incident”). All of the named defendants have now filed dis-positive motions. In addition, defendant Seiden has filed a motion pursuant to Fed.
