Ohio Supreme Court
1Opinion of the CourtAlien, J.
It is contended by the plaintiff in error:(1) That the court erred in holding that the tax commission of Ohio, under Section 5624-10, General Code, had the right to remit interest on delinquent taxes.(2) That the court erred in holding that Section 5704, General Code, with reference to publication by the auditor, is mandatory.(3) That the court erred in holding as immaterial the evidence offered by the plaintiffs in error tending to show impossibility of compliance with Section 5704 by the auditor.
