This is an original action commenced in this court by the State of Oklahoma on the relation of G. B. Fulton wherein he seeks a writ of mandamus requiring and compelling the defendant, the State Election Board of the State of Oklahoma, to strike from the ballots for the primary election the name of Elmer L. Fulton as a candidate for the Democratic nomination for the office of Justice of the Supreme Court from the Third Supreme Court Judicial District of the State of Oklahoma and to require the State Election Board to entelan order declaring the counter petition filed by one Elmer…
