This proceeding involves the constitutionality of section 5, ch. 58, Sess. Laws 1915, in that it is alleged to be violative of sections 57, 51, 46, and 32. art. 5, and section 7, art. 2, of the Constitution.

The controversy grew out of the following facts: The Oklahoma State Bank at Sentinel, Okla., having become insolvent, its affairs were taken charge of by the Bank' Commissioner. The United States Fidelity & Guaranty Company was surety for said bank for certain, deposits of the county funds of Washita county.
