The facts as disclosed in the pleadings and evidence are: That in •1888 appellant Ficke resided in Davenport, Iowa, and was engaged in the business of making farm loans in this state. In April, 1888, and for some time prior •thereto, one W. L. Coleman was engaged in business at •Lenox, Iowa, as a real-estate, loan, and insurance agent.
