!Appeal from Cedar District Court. — Hon. Milo P. Smith, Judge. Suit in equity to compel the city to make an assessment of the cost of a certain improvement against abutting property owners, for a. writ of mandamus, and for judgment for the value of the improvement against the city. The case was tried to the court, resulting in a decree dismissing plaintiff’s petition, and plaintiff appeals.

The controversy out of which this action arose has been prolonged and the history of the case is unique. Plaintiffs are contractors and as such they secured a contract with the defendant city for paving certain streets in said city, the costs thereof, except for street intersections, to be taxed up against owners of abutting property, and the contractors agreed to receive assessment certificates in full compensation for their work and materials.
