Johnnie Leach, plaintiff in error, who will hereinafter be referred to as defendant, was charged by information filed in the county court of Rogers county, Oklahoma, with the offense of transportation of intoxicating liquor, from an unknown point within the State of Oklahoma to certain points specified and set out. A motion to suppress was first heard and overruled, and the defendant waived trial by jury.
