On March 26, 2001, the defendants 1 moved, under Fed.R.Civ.P. 12(b)(6), to dismiss the second amended complaint for failure to state a claim [Doc. 31]. Plaintiffs Pacemaker Plastics Co. Inc., Thermal Foams, Inc., and Therma Foam, Inc., oppose the motion. On April 17, 2001, the plaintiffs filed a motion to amend the judgment of the dismissal of the first amended complaint under Fed.R.Civ.P. 59(e) [Doc. 40].
