On September 4, 1913, tbe appellee’s dwelling house located in Johnson county, Kentucky, about 74 feet from tbe track of'the appellant, was destroyed by fire, which occurred between 12:30 and 1:00 o ’clock P. M. on that day. Charging that tbe fire was due to tbe negligence of appellant both in tbe operation of its engine and in suffering and permitting tbe same to be out of repair and-not to have been equipped with tbe latest approved spark-arresters and appliances, as is required by section 782 of the Kentucky Statutes, thereby causing tbe fire,…
