DOOLING, J. pro tem.
This is an appeal from a judgment quieting plaintiff’s title to a certain lot of land against defendants’ claim of an easement for a right of way over a ten foot strip at the rear of said lot. The ease was submitted upon an agreed statement of facts supplemented by certain evidence. At the time of the creation of the easement the lot here in question was a part of a much larger tract of land, which has since been subdivided, and the easement was created by the owner of this larger tract by the same deed which conveyed to defendants’ and appellants’ predecessor the land…
