SCHROEDER, Justice.

This is an appeal of the dismissal of an attorney malpractice action. Kevin Lamb (Lamb) filed suit against Howard Manweiler (Manweiler) who had represented Lamb in criminal proceedings. Lamb contends that Manweiler was negligent in his representation. The district court granted Manweiler’s motion for summary judgment. The district court’s decision was vacated and the case remanded by the Court of Appeals. This Court granted Manweiler’s Petition for Review.
