MEMORANDUM AND ORDER

HATFIELD, Chief Judge.

The petitioner, Dan Nichols, challenges the judgment of conviction entered against him upon a trial by jury in the District Court of the Fifth Judicial District of the State of Montana for the criminal offenses of kidnapping and misdemeanor assault. See State v. Nichols, 222 Mont. 71, 720 P.2d 1157 (1986).
