THOMSON, District Judge.

This case is anomalous. The plaintiff alleges that, while president of the Crucible Steel Company, he made or caused to be made certain returns to the federal government, showing the income and excess profits tax of said corporation, and that because of acts done by him in connection with said tax returns he, together with the treasurer of the company, was indicted by a grand jury of the United States and tried for conspiracy to defraud the United States; that on that indictment he was tried and acquitted, and seeks in this action to recover from the corporation the…
