Respondent Russell Trask filed a legal malpractice action against Petitioner Richard Butler claiming professional negligence, breach of fiduciary duty, and breach of contract. Butler moved for summary judgment as to all of Russell’s claims. The trial court denied Butler’s motion. We granted discretionary review of an interlocutory decision to determine whether the trial court erred in denying Butler’s motion for summary judgment.
