TAMM, Circuit Judge:. This case is before the court on appeal from an order of the Federal Communications Commission (“Commission”) denying review of a decision of the Commission’s Review Board (“Board”) which denied the application of Lebanon Valley Radio, Inc. (“Lebanon Valley”) for a construction permit for a new broadcast station. Finding the Commission’s action erroneous, we reverse.
