BAZELON, Chief Judge:

In an earlier appeal we set aside the Federal Communications Commission’s grant, made without hearing, of a new standard broadcast station in Harriman, Tennessee, to appellant, F. L. Crowder. 1 We concluded that the Petition to Deny filed by Intervenor, Folkways Broadcasting Company, present owner of radio station WHBT in Harriman, raised sufficient questions “to require the probing of an evidentiary hearing.” 2 The Commission was directed to inquire “whether Crowder has engaged in trafficking of broadcast authorizations, and whether grant of [his] present application…
