We are asked to decide whether a petition under the Federal Arbitration Act (the “FAA”), 9 U.S.C. § 1 et seq., seeking to stay arbitration of claims that arise, in part, under the Securities Exchange Act of 1934 (the “Exchange Act”), 15 U.S.C. § 78a et seq., was properly: dismissed by the United States District Court for the Western District of New York, for lack of subject matter jurisdiction.
