The ultimate issue in this case involves the liability of a tenant, in a Wherry Housing Act project, for rent allegedly due a former holder of a leasehold interest for the one-month period following the filing of a complaint in condemnation and a declaration of taking, during which month the possession of the property remained in the former holder of the leasehold interest, James River Apartments, Inc., pursuant to court order.
