The plaintiff’s intestate was the driver of •■a street-railway car in the city of Grand Rapids, and on i;he 23d' day of April, 1889, while driving his car on "West Fulton street, in said city, was killed by a collision With a train of the defendant company at the street crossing. This is an action for damages on account of his death. Plaintiff recovered judgment in the Kent circuit court in the sum of $5,313.
