PANNELL, District Judge.
On August 13, 2003, Magistrate Judge Gerrilyn G. Brill entered a final report and recommendation in the present matter granting the defendant’s motion for summary judgment. The magistrate judge’s final report and recommendation was subsequently adopted by this court on September 12, 2003, and judgment was entered against the plaintiff.
