Criminal prosecution upon indictment for false pretense.

The bill, under which defendants are indicted, is as follows:

"The jurors for the State, upon their oath present, that J. P. Howley and Estella Howley, late of the County of Avery, wickedly and feloniously devising and intending to cheat and defraud Avery County Bank on the 21 day of February, A.
