DECISION AND ORDER

Plaintiff, Genesee Scrap & Tin Baling Co., Inc. (“Genesee”), brought this action against the City of Rochester, New York (“City”), seeking a declaration by this Court that a particular ordinance enacted by the City is unconstitutional. On July 30, 2007, in open court, I denied Genesee’s motion for a preliminary injunction, in which Genesee sought to enjoin the City from enforcing the ordinance pending a final determination on the merits of plaintiffs claims.
