Plaintiff, John Casciani, commenced this action under 42 U.S.C. § 1983 against defendants the Town of Webster, New York (“the Town”) and Webster Town Board Supervisor Ronald Nesbitt, alleging that defendants violated plaintiffs rights under the First and Fourteenth Amendments to the United States Constitution.
