MEMORANDUM OPINION

NEWBLATT, District Judge.

This is an action for a declaratory judgment respecting a settlement entered into by certain parties to a wrongful death action now pending in state court.

On or about January 12,1978, Wilhelm L. Linder was killed in an automobile accident when his vehicle collided with a vehicle owned by Raymond Ross (father) and driven by Michael Ross (son). On or about February 27, 1978, Linder’s personal representative instituted an action for wrongful death against Michael Ross in the Circuit Court for the County of Genesee alleging negligence.
