BATCHELDER, Circuit Judge.
Plaintiff Roseville Plaza Limited Partnership (“Roseville”) filed this products liability action on May 31, 1991, against defendant United States Gypsum Company (“Gypsum”), for the recovery of asbestos abatement costs. The complaint included claims for negligence, misrepresentation, breach of warranty, civil conspiracy, nuisance and restitution. Following the close of discovery, Gypsum filed four dispositive motions, including a motion for summary judgment.
