Appeal from Circuit Court, Harrison County. Bill by A. G. Smith against B. H. and J. W, Brown to dissolve the partnership of Smith, Brown & Co. From a decree for complainant, defendants appeal.

McWi-iorter, Judge:

On the 11th of August, 1870, A. G. Smith, B. H. Brown, and J. W. Brown entered into a written contract, forming a co-partnership, under the name of Smith, Brown & Co., *344to carry on the business of “general merchandising” for the term of five years from said 11th day of August, 1870, such business to be carried on at Clarksburg', Harrison County, W. Va., or such other place or places as the partners should thereafter determine, and which written contract contained the following provision: “That each of them, the said A. G. Smith, John W.
