MilleR, Judge :

This suit is to settle a partnership. On final hearing on bill, answer and report of the commissioner, the court below overruled the exceptions of appellant to said report and decreed that the special receiver, out of the fund in hand and to come into his hands, first, pay the costs of the suit, including five per centum commissions allowed him, second, all partnership debts unpaid, not including the debts decreed the individual members of the firm, as found by the commissioner, and third, the residue to be paid pro rata to the individual partners on the basis of $661.42,…
