The plaintiff brings this action to replevin an automobile sold to the defendant by the Archer-Motor. Co., Inc., under a conditional contract of sale. By the terms of the contract the vendor retained the title, with the right to retake possession on default, if any, of the stipulated payments. On the same day the contract was made it was assigned by the vendor to the plaintiff. It provided for the payment of $683.02 in monthly installments, consisting of eleven of $15 each and a twelfth of $518.02.
