NEWMAN, Justice.

On June 17,1993, following a seven day trial in the Court of Common Pleas of Philadelphia County (trial court), a jury found Miguel Rios (Appellant) guilty of first degree murder 1 for the shooting death of Jose Ortiz. The jury also convicted Appellant of three counts each of robbery 2 and unlawful restraint, 3 two counts of aggravated assault, 4 and one count each of burglary,I. **4 5 criminal conspiracy 6 and possession of an instrument of crime 7 .
