This is a motion to dismiss an appeal from a judgment in favor of the defendant upon the ground that the notice of appeal was filed more than 30 days after the denial of the motion for a new trial and more than 90 days after the entry of the judgment.
On August 14, 1947, judgment was entered in favor of the defendant. Notice of entry of judgment was served and filed on August 22. On August 29, the plaintiff filed his notice of intention to move for a new trial. The motion was heard on October 10, and denied in open court in the presence of counsel for both parties.
