Plaintiff was denied a portion of his accrued pension benefits and now brings claims under the Employee Retirement Income Security Act, 29 U.S.C. § 1001, et seq. (“ERISA”), the Labor Management Reporting and Disclosure Act of 1974, 29 U.S.C. § 401, et. seq. (“LMRDA”), and the Internal Revenue Code,. 26 U.S.C. §§411 and 412.
