This action arises out of the decision of defendant International Brotherhood of Electrical Workers Local Union 98 Pen sion Fund to deny a portion of the pension benefits sought by plaintiff Edward J. Foley, Sr. Plaintiff seeks to recover the denied portion of his pension benefits under the Employee Retirement Income Security Act, 29 U.S.C. § 1001, et seq. (“ERISA”).
