LITTLETON, Judge.
On October 5, 1954, 124 F.Supp. 650, we dismissed defendant’s fifth counterclaim based on the False Claims Act, 31 U.S.C.A. § 231 et seq., because the fraudulent acts alleged to come within that Act occurred more than six years prior to the filing of the counterclaim on June 29, 1953, and were therefore *802barred by the six-year period of limitations contained in the Act, § 235.
Defendant has now moved for a reconsideration of that decision and in so doing has raised an issue which was not heretofore presented to the court. Defendant’s position now is that assuming the…
