THIS MATTER is before the Court on the Defendants’ “Motion for Summary-Judgment” (document # 15) and “Memorandum in Support ...” (document # 16), both filed June 29, 2005; and the Plaintiffs’ “Memorandum of Law in Opposition ...” (document # 17) filed August 9, 2005.
