This was an action brought by the plaintiff, Robert Scully (“Scully”), against defendants, the Borough of Hawthorne, the Council for the Borough of Hawthorne (the “Borough Council”), Fred Criscitelli, David A. Noble, Lois Cuecinello, John G. Lane, Joseph Metzler, Marge Shortway, Patrick Botbyl, Brian Carmen and Joseph Walilko (collectively, the “Defendants”). 1 Scully sought to recover damages for an alleged wrongful demotion pursuant to 42 U.S.C. § 1983 (“Section 1983”) and various provisions of the laws of the State of New Jersey.
