FINDINGS OF FACT AND CONCLUSIONS OF LAW

ORLANDO L. GARCIA, District Judge.

This case was tried to the Court on August 21 and 22, 2000. After considering the pleadings, the evidence presented, the arguments of counsel, the post-trial briefs (docket nos. 163, 167, and 171), and the controlling legal authority, the Court enters its findings of fact and conclusions of law in accordance with Fed. R. Crv. P. 52.

The Court has federal question jurisdiction. 28 U.S.C. §§ 1331, 1367, 2201 and 2202.
