Adam A. Eobinson brought suit against Carl L. DeVaughn for damages alleged to have been sustained by reason of an illegal assault and battery made on him by the defendant. The petition, after certain portions had been stricken by a ruling .on demurrer, alleged that the families of the plaintiff and the defendant have been good friends all of their lives, and that there had never been the slightest friction between the plaintiff and the defendant prior to the alleged assault and battery; that the defendant married a niece of Mrs. A.
