John L>. Berry was indicted by the grand jury of Fulton county for the offense of assault and battery upon the person of O. LI. Stein. The indictment charged that the battery was done with a bottle. On the trial of the case the evidence showed that the plaintiff in error attacked Stein in the dining-room of the Kimball House, and it tended to show that at the time the assault was made, Stein was at a table reading a paper; that the plaintiff in error approached him, leaned over, got a bottle from the table and struck him, felling him to the floor, etc.; and that two or three blows were…
