This action was brought to recover damages for alleged malpractice by a physician in the use of the X-ray and from a judgment non obstante veredicto of no cause of action for defendant, plaintiff appeals.

On November 26, 1937, Erwin T. Facer consulted Dr. Sol. M. Lewis, defendant herein, because of warts on his feet. Mr. Facer had so many warts on his right foot that it was impossible to accurately count them. They seemed to radiate between the fourth and fifth toes on his right foot.
