SIMMS, Justice:

Department of Human Services (DHS), appeals from summary judgment entered by the district court in favor of appellee, Board of County Commissioners of McClain County (County). The district court held that no statutory authority supported the claim of DHS for reimbursement for medical services rendered to an injured prisoner in custody of the McClain County Sheriffs Department and that the Oklahoma Constitution prohibits the use of ad valorem taxes to pay DHS for the services.
