BOOKHOUT, Associate Justice.
This is an appeal from a judgment rendered in the District Court of Van Zandt County, at the fall term, 1903, of said court, against the appellant in a suit brought to recover damages for personal injuries alleged to have been sustained by the appellee on the 8th day of May, 1902, while appellee was an employe of appellant as a laborer in a construction gang. A trial resulted in a verdict and judgment for plaintiff, and defendant appealed.
