Appellant, claiming to be a bona fide purchaser for value of a negotiable promissory note, brought this action against the makers thereof "to enforce its payment. The defendants, asserting that the note was non-negotiable, interposed a defense valid against the payee therein. The court instructed the jury that the note was non-negotiable and that the defense, if established, would defeat recovery on the note.
