BORAH, Circuit Judge.

This is an appeal from a judgment in favor of the appellee insurance company in a suit predicated on its alleged negligence and bad faith in failing and refusing to settle an action for wrongful death brought against appellant, the insured, by Mrs. John W. Cassell.

Appellant, C. M. Hall, doing business as Hall Motors, satisfied a judgment for $8,000.00 with interest which Mrs. Cassell obtained 1 against him by reason of the negligent act of appellant’s employee in the operation of an automobile owned by appellant.
