OPINION

Riner, Chief Justice.

The record in this case, here by direct appeal, brings in question the propriety of a judgment of the District Court of Weston County. The plaintiffs, E. P. Johnson and Pearl J. Johnson, his wife, respondents in this court, brought an action against John Szumowicz as defendant and now the appellant, for the recovery of certain lands in the county above mentioned, based on a claim of ownership thereof by purchase and warranty deed therefor.
