BYE, Circuit Judge.

The government appeals from the district court’s grant of a motion for judgment of acquittal and the district court’s decision to depart downward at sentencing. We reverse the district court’s order granting judgment of acquittal, vacate the sentence and remand for resentencing.

On October 22, 1999, St. Louis police were alerted by a New Mexico Drug Enforcement agent that a person attempting to buy a ticket on Amtrak’s Chicago to Los Angeles route, which goes through St. Louis, was a suspected drug courier. On the same date an Amtrak ticket agent contacted his supervisor…
