MANION, Circuit Judge.
Plaintiff Peter C. Kostantacos (Kostanta-cos) brought this securities fraud class action suit against several defendants, including the appellant, Piper, Jaffray & Hopwood, Inc. (PJH). PJH filed a motion to stay litigation and compel Kostantacos’ claim to arbitration pursuant to the parties’ arbitration agree ment. The matter was referred to a magistrate judge who recommended that PJH’s motion be granted. The district court agreed with this recommendation and entered an order compelling arbitration and staying the proceedings pending arbitration.
